By accessing or using the www.naturebooker.com ( 'Site') website, you agree to be bound by the terms and conditions set forth below which constitute a contract ( 'Agreement') between you and Groupe NatureBooker Inc. ( 'NatureBooker').

You acknowledge that you have read and understood the Agreement and you expressly agree to abide by the Agreement and any changes thereto (as indicated below).

NatureBooker reserves the right, at its sole discretion, to modify the Site, the services offered, or to update, modify, add or remove provisions of the Agreement at any time and without notice. In such case, NatureBooker Will publish on this page the modifications made to the Contract by including at the top of the page the last date of revision of the Contract.

Main definition

  • 'Client' means any user who accesses or uses the Site.
  • 'Trader' means businesses or individuals offering activities or offers on the Site;
  • 'User' means Customers and Merchants;
  • 'Services' means the services offered by NatureBooker, to act as an intermediary between the Merchants and the Customers in order to allow the Users to benefit from the interesting offers of the Merchants;

Eligibility

By entering and using the Site or the Services, you represent and expressly warrant that you have the legal right to enter into the Agreement. You further represent and warrant that you are of full age or have any documents required or To use the Services, failing which, you may not browse the Site or use the Services.

Object

The Site constitutes a platform for consulting, searching and reserving activities and offers in the hunting, fishing and outdoor activities. Merchants may create advertisements in order to promote on the Site their offers of activities and offers in the areas mentioned above and to allow the booking by the Customers (the 'Offer').

Scope of Services

You understand and agree that NatureBooker is not a travel agent within the meaning of the Quebec Travel Agents Act . Its role is limited to acting as an intermediary between Merchants and Customers, that is to say to supply the Users with the availabilities of the Offers listed on its Site and to send their requests for reservations to the Merchants You acknowledge that the obligation of NatureBooker is one of average and not of result.

Account and password

All information used to create an account must be true, complete and promptly updated in the event of a change.

You are responsible for maintaining the confidentiality of your password NatureBooker can not be held liable for any unauthorized use of your account, in case the confidentiality of this information is compromised, please notify NatureBooker as soon as possible to avoid possible fraudulent use of your account.

Offers

The various offers advertised on the Site are offered by the Merchants and may vary from time to time, NatureBooker being an intermediary, the conditions, rights and obligations arising from an Offer, Modalities and payment, shall be determined by the Merchant.

When booking an Offer with accommodation, a minimum number of nights may be required by the Merchant, which may vary depending on the high season or low season of the Offer presented by the Merchant .

Offer Price

Offer prices must be paid in the currency indicated at the time of purchase, plus taxes. Offers payable in a currency other than Canadian will be converted at the daily exchange rate and are subject to additional conversion fees .

Prices are subject to change at any time. Offers are always invoiced based on the rates in effect at the time of purchase.

Terms of payment by Customer

The Customer agrees to pay NatureBooker, according to one of the following terms and conditions specified in the Offer:

  • payment of the full price of the Offer, including applicable taxes, upon booking, or
  • a minimum non-refundable deposit of the amount shown in the Offer at booking or by default representing twenty percent (20%) of the price and the final payment of the balance to be made
    • on the date indicated in the Offer or by default thirty (30) days before the date of the offer, or
    • 'on the spot' when you register for the offer or activity directly with the Merchant.

In case a deposit is required, payment of this deposit is necessary to keep the Customer's place and confirm his reservation.

In the event of failure to pay in accordance with the aforementioned terms or for which payment is not honored by a credit institution, the reservation may be canceled automatically and without notice and, if applicable, the amount of Non-refundable deposit. Certain administrative fees may also apply.

All payments are made by the Customer by credit card Visa, MasterCard or American Express via the secure payment gateway Stripe.

NATUREBOOKER IS NOT RESPONSIBLE FOR PAYMENT PROBLEMS RELATED TO THE OPERATION OF THE ELECTRONIC COMMERCE SERVICE.

The Customer is responsible for transmitting all requested information concerning his credit card. The Customer declares to be the holder of the credit card or, failing this, has the consent of the cardholder.

Customer authorizes NatureBooker to transmit all credit card information to Merchants.

The Customer authorizes and agrees that each payment will be made in one or more withdrawals by NatureBooker. The Customer authorizes NatureBooker to make one or more withdrawals from his / her credit card to the extent that all Withdrawals from the Merchant and those of NatureBooker are in accordance with the prices mentioned in the Offer.

NatureBooker reserves the right to change the methods of payment available or to use other suppliers to do so.

Fees payable by the Merchant

When publishing each of its offers, the Merchant chooses a commission payable on the price, set at 10% by default, before taxes and before any promotion, discount or promotional code, applicable on each booking made by a Customer on the Site or on a website of an affiliate partner.

Fees and commissions are payable in Canadian dollars and in the manner set out in the following section.

No commission is payable for any booking using the NatureBooker booking engine directly on the Merchant's site if the Customer is not directly from the NatureBooker Site or its affiliated partners within 30 days of the reservation.

No commission is due from the Merchant who uses the Site himself to reserve his Offers for his clients.

Method of payment by NatureBooker and the Merchant

Following the booking of an Offer by a Merchant Customer, the merchant who created his Stripe account will automatically and immediately receive the full amount of the booking less the amount equal to the commission that is due to NatureBooker, which will be retained by latest.

In the event that the commissions due are not paid in accordance with the preceding paragraph, the Merchant agrees to pay them to NatureBooker no later than seven (7) days after the activity or offer. Interest rate of two percent (2%) per month, or twenty-four percent (24%) per year.

Equipment and materials required

When you make your reservation, you will receive a confirmation email including dates, number of people and details of the reservation, as well as the applicable cancellation and refund policies. Please contact the Merchant directly if you have any questions regarding the services and equipment provided for your activity. You also have to provide all necessary equipments for the comfort of Children who accompany you and who could, in certain cases, be calculated in excess of the maximum occupancy capacity: mattresses, bedding, etc.

Cancellations and refunds

Each Offer is subject to the cancellation policy of the Merchant that you have accepted at the time of booking and which will also be found in the confirmation email you will receive.

Free for Customer

Use of the Site is free of charge to the Customer. Each merchant can choose not to pay any fees or commission for NatureBooker services. In this case, NatureBooker reserves the right to charge the customer a 5% fee for its services, when the Customer makes a reservation via the Site.

Obligations and responsibilities of Clients

The Client is solely responsible for:

  • verifying, respecting and complying with any law, regulation, decree or standard, of whatever nature, applicable to the places visited;
  • ensuring that he holds and will have in his possession all permits applicable for the pursuit of hunting and fishing activities and, if necessary, a valid passport, visa and any other required or valid travel document.
  • verifying and deciding whether or not to follow the health recommendations and / or requirements.
  • reading and accepting the applicable terms and conditions of the Merchant and any partner of the Merchant.

NatureBooker shall not be held responsible for any omission or negligence whatsoever directly or indirectly caused by the Customer as a result of the Customer's decision.

Merchant's Obligations

Whenever the Merchant transmits an Offer to the Site, it expressly acknowledges that:

  • He has the legal right to conclude the Contract and be able to validly offer, as owner or tenant, the Offers to the Customers on the Site; You can not submit Offers on the Site if you act as agent for a third party;
  • He represents a corporation legally incorporated and entitled to carry on business in Canada in accordance with applicable laws, regulations and practices;

A Merchant who does not comply with any of the aforementioned obligations may not publish an Offer on the Site and must notify NatureBooker of any irregularities in writing without delay.

Conditions related to offers

The Merchant is solely responsible for indicating any relevant information necessary in regard with the Offer, including any applicable conditions or restrictions, and shall be responsible for ensuring that appropriate information is provided to Customers.

The Merchant must respect, for the duration indicated, the Offers posted on the Site and must display the exact regular price.

Following reservations, the Merchant is responsible for modifying on the Site the dates on which the Offer is no longer available. The Merchant is at all times responsible for ensuring that the Offers are in conformity and available according to what is posted on the Site and compensate a Customer if a problem should arise.

Although NatureBooker takes care to check frequently the information regarding the Merchants and their offers posted on the Site, it is possible that some information may be erroneous, inaccurate or outdated.

NatureBooker reserves the right, without prior notice and in its sole discretion, to remove any error or inaccuracy of information and agrees to contact the Merchant in all cases to notify and request a correction of the situation.

Code of Conduct

You shall not upload, post, transmit, share, stock or distribute in any other way on the Site content that is injurious, threatening, unlawful, defamatory, infringing, abusive, harassing, vulgar, obscene, fraudulent, invasive of privacy or intellectual property of others, hateful, inciting violence, racial, hatred or otherwise objectionable. the User agrees to use the Site and the Services in accordance with the laws.

You are prohibited from allowing acts that could infringe the rights of others and the enjoyment of the service, including:

Corporate identity fraud : You can not use personal or confidential information to create an account or otherwise make believe that you are a person or a company that you are not.

'Spamming' or abuse : You cannot perform acts considered as spamming on the Site. What constitutes spamming evolves with new tricks and tactics set in motion by spammers. The following elements are used to determine whether you are spamming or abusing the Site:

  • You can not create a series of accounts. Creating multiple accounts by a User is a reason for suspending all accounts.
  • If more than one user makes negative comments about the sales process with you (Offers not respected, etc.)
  • the number of complaints received in your regard;
  • if you publish several times the same offer on the same day;
  • If you send messages to a User outside the framework of the transaction or following the transaction, without the authorization of the other party.

Intellectual Property

All content specific to the Site (text, illustrations, styles, photos, images, design, functionalities and others) are the exclusive property of NatureBooker.

However, each Merchant shall at all times remain the owner of its name, logo, texts, illustrations, photographs, images or other content that it publishes on the Site. The Merchant gives NatureBooker a free, perpetual, irrevocable and not exclusive license to use, publish, edit, translate, distribute, display any content and use its intellectual property (logo, product image, product or service description) for promotion and marketing purposes on the site or the site of an affiliated partner.

For any other promotion, distribution or marketing outside the Site or the site of an affiliated partner, NatureBooker will request written authorization from the Merchant to do so.

All content is protected by copyrights and intellectual property rights worldwide. Any reproduction of the Site or any part of it is protected by the intellectual property of NatureBooker or the Merchants. You cannot modify, copy, distribute, transmit, display, reproduce, publish, license, transfer or sell any information, software, products or services obtained from the Site. You cannot neither create nor derived content from the aforementioned elements.

NatureBooker respects copyrights laws and expects its users to do so. NatureBooker's policy is to terminate, if circumstances justify, the accounts of Users who violate or are suspected of violating copyrights. In addition, NatureBooker reserves the right to sue any User for damages in the event of such infringement.

Network security and efficiency

You agree not to use the Site in a manner that may compromise, disable or overload the Site.

NatureBooker does not guarantee efficiency or total network security. It is possible that a hacker manages to penetrate the server so it is important to keep in mind that a malicious person could possibly access NatureBooker's servers and use personal information left by users on the Site for its own purposes. In no case, neither NatureBooker nor any of its directors, officers, employees, agents or representatives could be held responsible for acts of computer piracy or be blamed for any damage or loss that may result to a User.

The Service may be subject to occasional breakdowns and programming errors that can be caused by updates or by events beyond the control of the administrators. Neither the directors, officers, employees, agents nor representatives of NatureBooker could be held responsible if a user finds himself unable to browse the Site whatever the reason which prevents him to do so (misunderstanding, faulty telephone line, incompatible modem, broken cable, improper configuration, incorrect Browser, etc.).

Limitation of liability

NATUREBOOKER OFFERS ITS SERVICES 'AS IS' WITHOUT WARRANTY OR CONDITION, EXPRESS OR IMPLIED, AND MAKES NO REPRESENTATIONS OR WARRANTIES. IN NO CASE NATUREBOOKER, ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS OR REPRESENTATIVES COULD BE HELD RESPONSIBLE FOR ANY CLAIMS OR DAMAGES, DIRECT OR INDIRECT, ARISING FROM THE USE OF THE SITE OR SERVICES PROVIDED BY MERCHANTS, INFORMATION CONTAINED ON THE SITE OR OF THE INTERPRETATION OF THIS AGREEMENT.

THE CUSTOMER ACKNOWLEDGES THAT NATUREBOOKER CANNOT BE HELD LIABLE FOR ANY DAMAGE, LOSS, THEFT, ACCIDENT, INJURY OR DAMAGE ARISING DIRECTLY OR INDIRECTLY, FROM THE LIABILITY OF SERVICE RENDERED BY A MERCHANT.

However, any user can send any relevant comments or complaints related to another User to NatureBooker through an email by clicking Here .

IN NO CASE NATUREBOOKER WARRANTS THE RESULTS OF THE DISPLAY OF AN OFFER, THE REPRESENTATIONS AND WARRANTIES OF TRAFFIC ON THE SITE OR THE VISIBILITY REGARDING THE MERCHANT.

TO THE EXTENT PERMITTED BY LAW AND IN ALL CASES WHERE THE LIABILITY OF NATUREBOOKER BE COMMITTED IN ACCORDANCE WITH THE DISPOSITIONS OF THIS AGREEMENT, THE TOTAL LIABILITY OF NATUREBOOKER, ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, REPRESENTATIVES OR ITS AFFILIATES ARISING DIRECTLY OR INDIRECTLY OUT OF THIS AGREEMENT IS LIMITED TO THE AMOUNT OF THE COMMISSION PAID RELATIVE TO THE CUSTOMER OFFER OR SERVICE.

Use of the Website is at your own risk and NatureBooker will not take any responsibility for any damages whatsoever with respect to the user agreement.

Compensation

You agree to release, defend, indemnify and not hold responsible NatureBooker or their officers, directors, employees and agents from any claims, liabilities, damages, losses and expenses, including, without limitation, reasonable legal and accounting costs arising out of or in any way related to;

  • your access to or use of the Site or the Services or a breach to the contract done by you;
  • your interaction with any Merchant;
  • your booking or use of any Offer;
  • Any disagreement or dispute that may arise between you and another User, NatureBooker will not attempt to resolve any such dispute and will not take any action to stop any harm, so it is your responsibility to resolve any disagreements.

Suspending your account

NatureBooker reserves the right to permanently suspend any account that does not comply with this Agreement without notice or delay. If you believe that your account has been suspended for no reason, you may contact NatureBooker's team.

Accounts created to replace a suspended account will also be permanently suspended.

Communication with users

By accessing and using the Site, you authorize NatureBooker to communicate with you by e-mail as well as by telephone. You agree that NatureBooker sends you all relevant information concerning the use of its services, Special offers, etc. At any time you can unsubscribe from NatureBrooker's mailing list.

As long as you subscribe to the Site, NatureBooker may provide you with information related to the use of the Site.

Nullity

Without limiting the generality of the foregoing, NatureBooker will not be held responsible for the non-performance, in whole or in part, of any of its obligations to you, or for any damages or losses you may suffer, damages or loss resulting from natural disasters or circumstances beyond its control.

Dispute

Notwithstanding the applicable law section of this Agreement any dispute regarding this Agreement that can not be settled by negotiation between the parties or their representatives shall be submitted to arbitration in accordance with the provisions of the Code of Civil Procedure of the Province of Quebec (Canada).

Applicable law

The Agreement is governed by the laws of the Province of Quebec, Canada, and you hereby acknowledge that any and all disputes arising out of or relating to the use of the Services, the Site or the Contract shall be subject to the jurisdiction of the Courts of the District of Quebec, Province of Quebec (Canada).
